Albania · Residence procedure
How do you apply for an Albanian residence permit?
Enter Albania lawfully — visa-free or on a type D long-stay visa — then file the temporary residence application online through e-Albania with the local border and migration authority within 30 days of entry. The central authority approves the permit and the local authority issues it to the applicant. Renewals are filed within 60 days before the existing permit expires. The detailed document list is set by a Council of Ministers decision and shown in the application itself.
1. A visa and a residence permit do different jobs
A visa answers whether you may enter and stay briefly; a residence permit answers whether you may stay beyond 90 days. Article 31(2) caps short stays at 90 days in any 180-day period, so anything longer requires a temporary residence permit under Article 37.
Where the applicant enters on a type D long-stay visa, the ground of the residence permit must match the purpose of the visa (Article 33(1)). Where the applicant enters visa-free, the application must be filed within the lawful stay. Confirming the entry route first avoids a round of corrections later.
- Visa-free or short-stay visa: stay only — no work, no long-term residence
- Type D long-stay visa: residence application on the same ground
- Residence permit: required to stay beyond 90 days
- Work: normally a single permit combining residence and work
2. The six-step process, in the order the law sets it
Article 33 splits competence in two: the central authority responsible for foreigners, after consulting the State Intelligence Service and the security services, approves the permit; the regional or local authority issues it to the foreign national. Article 37 fixes the timing and the content of the application. Read together, they describe a sequence an applicant can actually follow.
One step is easy to overlook: under Article 36(3), a holder of a permit valid for at least one year must register as a temporary resident with the civil registry office of the local government unit where they reside, and must notify the authorities whenever the address changes.
- 1. Lawful entry — visa-free or with a type D visa
- 2. Within 30 days of entry, file online through e-Albania (Article 37(1))
- 3. The local authority receives and screens the file; missing documents are requested with a 30-day cure period (Article 37(3))
- 4. The central authority approves, the local authority issues the permit (Article 33(2))
- 5. Collect the permit; permits of one year or more are registered with the civil registry (Article 36(3))
- 6. Renew: file within 60 days before expiry (Article 37(1))
3. Documents are grouped by the ground of residence
Article 39 lists the grounds: family reunification; study; unpaid traineeships; au pairs; youth exchanges; research; job-seeking by researchers and students; humanitarian cases; trafficking victims; stateless persons; work-based single permits (employee, seasonal work, intra-corporate transfer, cross-border worker, vocational training, athlete, voluntary service, highly qualified worker, self-employed, digital mobile worker, investor, contractual services and special categories); crew members; owners of immovable property; and pensioners.
Because the document list is set by a Council of Ministers decision (Articles 33(6) and 37(1)), the ground determines the document set. In practice it falls into four groups: identity (passport, photographs); ground (employment contract, title deed, admission letter, pension statement); support (housing, health insurance, stable income); and compliance documents such as criminal-record certificates. Never reuse an old checklist for a new application — the form governs.
- Work: employment contract or employer authorisation, through the single permit
- Property: title deed and housing that meets the standard
- Family: relationship documents plus the sponsor's permit, income, housing and insurance (Article 41)
- Pensioners and digital nomads: pension or remote-work evidence and proof of income
4. Family reunification: the six conditions in Article 41
The sponsor must hold a residence permit valid for at least one year and be able to renew it; family members must in principle apply from outside Albania (humanitarian exceptions aside); the sponsor must provide housing that meets general health and safety standards, health insurance covering the family, and stable financial resources without resorting to social assistance; and the documents required by the Council of Ministers decision must be filed.
A family reunification permit is issued for one year at a time and is renewable. Unmarried children may apply up to the age of 30 where the sponsor covers all their living costs, and parents who cannot meet their own needs for health reasons may be admitted as exceptional cases. After five years of continuous family residence, an autonomous permit becomes available (Article 42).
- Sponsor's permit valid for at least one year and renewable
- Family members abroad, except on humanitarian grounds
- Standard-compliant housing, family health insurance, stable income
- Unmarried children up to 30; parents on health grounds as exceptions
5. Which steps require the applicant in person
What the law spells out is an online application and issuance of the permit by the local authority to the foreign national. It does not turn every step into a remote one. The application can be completed online, but collecting or verifying the permit, registering with the civil registry and the consular visa stage will normally require the applicant to appear.
Whether fingerprints are captured or the card must be collected in person depends on the practice of the competent local authority at the time. Publishing a fixed “must appear in person” list would mislead clients; the correct approach is to confirm with the receiving office before travelling.
- Online: form, uploads, status tracking
- Usually in person: border control on entry, permit collection or identity verification at the local office
- In person: civil registration for permits of one year or more
- Depends on the consulate: type D visa submission and biometrics
6. Six grounds for refusal or annulment
Article 34 lists the grounds on which a permit may be refused or annulled: failure to file or complete documents within the deadline without good reason; inability to show that the conditions are still met; a threat to public order or national security; dissolution of the marriage behind a family reunification permit; the ground for the permit no longer existing; documents obtained by fraud; and more than 180 days outside Albania within a one-year permit.
A refusal must be notified in writing with reasons, the resulting obligations and the appeal route, deadlines and authority (Article 34(3)). Where a cure period is granted, the 30-day window is the critical milestone: missing it extends the procedure and may be treated as non-filing.
- Documents not completed in time
- The ground has disappeared (job ended, property sold, studies finished)
- Marriage behind a family permit dissolved
- More than 180 days abroad within a one-year permit
- Fraudulent documents
- Threat to public order or national security
Frequently asked questions
Must the application be filed within 30 days of entry?
Article 37(1) requires the temporary residence application within 30 days of entry and within the lawful stay. Visa-free visitors have a shorter lawful stay, so the practical window depends on the entry stamp and the law.
Can I enter first and look for work afterwards?
Work-based residence normally requires a single permit, which presupposes an employer authorisation. Working while admitted as a visitor or visa-free is not consistent with the permit conditions.
Can my family apply at the same time?
Yes, subject to Article 41: a sponsor holding a permit valid for at least one year and renewable, family members abroad except on humanitarian grounds, housing, family health insurance, stable income and the required documents.
How early should a renewal be filed?
Within 60 days before the existing permit expires (Article 37(1)). More than 180 days abroad within a one-year permit may lead to annulment, so check the travel record before renewing.
Is there an appeal against refusal?
Yes. Article 34(3) requires the written notice to state the reasons, the resulting obligations and the right of appeal, its deadline and the authority to which it is addressed.
